1.    GENERAL: 

Kröll's Alpenwelt GmbH & Co KG, FN 242933f, Königsleiten 81, 5742 Königsleiten, is the operator of the online store available at www.myalpenwelt.shop These General Terms and Conditions (hereinafter referred to as “GTC”) apply to orders and the use of the website. The www.myalpenwelt.shop offers the opportunity to purchase voucher cards for services and the purchase of products.

2.    SCOPE OF APPLICATION

2.1 These General Terms and Conditions (hereinafter referred to as “GTC”) of the company Kröll's Alpenwelt GmbH & Co KG (hereinafter referred to as ‘Seller’) shall apply to all contracts concluded between a consumer or a trader (hereinafter referred to as “Client”) and the Seller relating to all goods and/or services presented in the Seller's online store. These GTC apply accordingly to contracts for the delivery of vouchers, unless expressly stipulated otherwise. The inclusion of the customer's own terms and conditions is hereby objected to, unless otherwise agreed.

2.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession.

An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
 

2.3 The subject matter of the contract is set out in the respective description of the goods or voucher provided by the seller. The subject matter of the contract can be both the purchase of a voucher or goods by way of a one-off delivery and the purchase of goods by way of a permanent delivery (hereinafter “subscription contract”). In the case of a subscription contract, the seller undertakes to deliver the contractually owed goods to the customer for the duration of the agreed contract term at the contractually owed time intervals.

3.    CONCLUSION OF CONTRACT

3.1 The goods and vouchers displayed in our online store are merely to be understood as an invitation to order and do not constitute a binding offer. During the ordering process, you can correct input errors by clicking on the “Back” button and then re-entering them. Your order is placed by clicking on the “Order with obligation to pay” button and constitutes a binding offer to conclude a purchase contract for the selected goods, which becomes effective when all necessary and required data for payment processing is provided. You are obliged to enter the data correctly. After sending the order, a confirmation will be sent by e-mail in which all relevant order data is summarized. This electronic order confirmation does not constitute acceptance of the purchase offer, but merely documents that the order has been received.

The purchase contract for the voucher(s) is concluded when we make the ordered voucher(s) available to you digitally for downloading and printing (Print@home) in the voucher store and by e-mail after payment has been made. If you select the corresponding option in the voucher store, the ordered voucher can also be sent by post to the address you have provided. No liability is accepted for late delivery by post.

The purchase contract for goods is concluded when, after payment has been made, either the ordered goods are dispatched or the order is expressly accepted by means of an order confirmation by fax or e-mail within seven days of receipt of the order. Delivery is generally made within three to five days to the address in Austria stated in the order. However, the delivery periods are non-binding. Compensation for damages in the event of late or non-delivery is excluded except in the case of intent or gross negligence on the part of the seller. Deliveries outside Austria in particular may take considerably longer.

3.2 It is also possible to purchase vouchers directly at Alpenwelt Resort Königsleiten during their business and opening hours.
              
3.3 The seller is entitled, but not obliged, to accept the purchase offer. An order is only valid if the customer data is complete and correct. A minimum age of 18 years applies to online orders. By placing an order, you confirm that you have already reached the age of 18.

3.4 The seller reserves the right to change the respective range of services on an ongoing basis. Minor deviations (e.g. color, size) of the products shown on the website cannot be excluded.

3.5 The contract language is German.

4.    DELIVERY AND SHIPPING CONDITIONS

4.1 Unless otherwise agreed, the goods shall be shipped to the delivery address specified by the customer.

4.2 If the transport company returns the shipped goods to the seller because delivery to the customer was not possible, the customer shall bear the costs for the unsuccessful shipment. This does not apply if the customer effectively exercises his right of withdrawal, if he is not responsible for the circumstance that led to the impossibility of delivery or if he was temporarily prevented from accepting the service offered, unless the seller had notified him of the service a reasonable time in advance.

4.3 If the customer acts as an entrepreneur, the risk of accidental loss and accidental deterioration of the goods sold shall pass to the customer as soon as the seller has delivered the goods to the forwarding agent, carrier or other person or institution designated to carry out the shipment. If the customer is acting as a consumer, the risk of accidental loss and accidental deterioration of the goods sold shall not pass until the goods are handed over to the customer or a person authorized to receive them. Notwithstanding this, the risk of accidental loss and accidental deterioration of the goods sold shall pass to the customer, even in the case of consumers, as soon as the seller has delivered the goods to the forwarding agent, the carrier or the person or institution otherwise designated to carry out the shipment, if the customer has commissioned the forwarding agent, the carrier or the person or institution otherwise designated to carry out the shipment and the seller has not previously named this person or institution to the customer.
 

4.4 The Seller reserves the right to withdraw from the contract in the event of incorrect or improper self-delivery. This shall only apply in the event that the Seller is not responsible for the non-delivery and the Seller has concluded a specific covering transaction with the supplier with due care. The seller shall make every reasonable effort to procure the goods. In the event of non-availability or only partial availability of the goods, the customer will be informed immediately and the consideration will be refunded without delay.


4.5 In the case of self-collection, the seller shall first inform the customer by e-mail that the goods ordered by him are ready for collection. After receiving this e-mail, the customer can collect the goods from the seller's registered office by arrangement with the seller. In this case, no shipping costs will be charged.


4.6 Vouchers are provided to the customer as follows:

- by download
- by e-mail
- by post

5.    PRICES AND TERMS OF PAYMENT

5.1 All prices quoted are final prices and include VAT. A minimum order value of € 20.00 (twenty euros) applies.

5.2 Shipping costs will be added to the indicated product prices. For the delivery of the vouchers or other products, the shipping costs indicated on the website must be paid by the customer.

5.3 You can pay for the voucher(s) or the other products in the online store by credit card (Mastercard/Visa) or instant bank transfer. Payment for goods from the online store (but not vouchers) can also be made with a previously purchased voucher.

5.4 Retention of title: The seller retains ownership of the delivered goods until the purchase price owed has been paid in full or a voucher is not valid.

6.   CONTENT OF THE VOUCHERS AND REDEMPTION

6.1 The vouchers offered are value or multi-purpose vouchers with a non-binding redemption recommendation, which can be redeemed for all services of Alpenwelt Resort Königsleiten. Redemption may differ from the recommendation and is possible for all services offered at Alpenwelt Resort Königsleiten or for payment of goods in the online store. If the actual value of the service used differs from the value of the voucher, any remaining amount can be used for other services or an additional charge will be made. The value is stated on the voucher. The voucher can also be redeemed for overnight stays and all other hotel services. If a specific service is indicated on the voucher, this is merely a recommendation for redemption. If, for example, the voucher mentions breakfast, this voucher can also be redeemed for a ride in the electric trial park or another (hotel) service instead of breakfast. Please note that a vacation booking or an agreed treatment date is binding, the corresponding cancellation conditions apply. The vouchers offered in the MYALPENWELT vacation packages category have been created on the basis of prices for the cheapest season. If the vouchers are redeemed in a different season, we ask for your understanding that a corresponding surcharge will be charged on site. 6.2 Several vouchers can be redeemed for one order or one stay at Alpenwelt Resort Königsleiten.

 
6.3 Vouchers can only be used for the purchase of goods in the online store or in the Alpenwelt Resort Königsleiten or for the use of services in the Alpenwelt Resort Königsleiten, but not for the purchase of further vouchers.
 
If the value of the voucher is not sufficient to cover the selected service or goods, one of the other payment methods offered by the seller can be selected to settle the difference.

 
6.4 The credit balance of a voucher is neither paid out in cash nor does it bear interest.

 
6.5 The voucher is transferable, i.e. it is only necessary to present the voucher when redeeming it. It is generally not possible to block the voucher (e.g. in the event of loss, theft, etc.). The vendor cannot accept any liability for the unlawful redemption of a voucher and is therefore not obliged to provide compensation in the event of the loss, theft, etc. of a voucher.

 
6.6 The issue of a VAT-compliant invoice with corresponding proof of tax can only take place at the time of redemption of the voucher and thus the actual provision of the service.
 
Each voucher can only be redeemed once, which is ensured by a barcode or voucher number linked to the voucher.

 

 
6.8 Deviations in illustrations of the goods for sale are possible. Errors, typesetting and printing errors excepted.

7.    VALIDITY

The vouchers are redeemable up to five years after purchase (date of issue) (expiry date). The redemption period for any remaining balance is not extended by partial use.

8.    WARRANTY RIGHTS

The statutory warranty rights apply.

9.    SECURITY GUARANTEE & DATA PROTECTION

Your security is our top priority. Therefore, data such as credit card number, bank code, account number, name and address are transmitted via a protected SSL line when paying by credit card. This means that no unauthorized person can read the data you enter during transmission over the Internet. In order to provide additional security in the voucher store, we use a number of additional security measures. Your details are processed automatically by us. This data will not be passed on to third parties.

10. APPLICABLE LAW

All legal relationships between the parties shall be governed exclusively by Austrian law, with the exception of those conflict-of-law rules of the Austrian legal system that conflict with this choice of law. In the case of consumers, this choice of law shall only apply insofar as the protection granted by mandatory provisions of the law of the country in which the consumer has his habitual residence is not withdrawn. Exclusive place of jurisdiction: the competent court for Königsleiten.

The above provisions apply equally to the purchase of vouchers on site at Alpenwelt Resort Königsleiten, unless expressly agreed otherwise.

11. REVOCATION

Right of withdrawal

You have the right to withdraw from this contract concluded via the website   www.myalpenwelt.shop within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods (or the last goods, in the case of a contract for several goods of a uniform order), provided that the voucher has not yet been redeemed.

 
To exercise the right to cancel, you must inform us, Kröll's Alpenwelt GmbH & Co KG | Das Alpenwelt Resort, Königsleiten 81, 5742 Königsleiten, Tel.: +43 (0) 6564 8282, Fax: +43 (0) 6564 8282 7, E-Mail: rezeption@myalpenwelt.at, of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.
 
To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

Please note that the right of withdrawal does not apply if you purchase the voucher(s) or goods directly from Alpenwelt Resort Königsleiten.
